Abstract : This research is a jurisprudential, deep-rooted,applied study that deals with the rulings of necessity related to women in the chapters on acts of worship, family’s jurisprudence, and penalties(punishments): “a comparative jurisprudential study”. It consists of an introduction, three chapters, conclusion and indexes. Chapter One: The Jurisprudential necessity. This includes two topics: Topic One: A definition of necessity and its controls. Topic Two: addressing the most important jurisprudential rules related to necessity. Chapter Two: The rulings of necessity related to the acts of worship. It includes three topics. Topic One: dealing with the rulings of necessity related to purification. Topic Two: dealing with the rulings of necessity related to prayer. Topic Three: the necessity rulings related to fasting and pilgrimage. Chapter Three: The rulings of necessity related to the laws of personal status and penalties. It comprises two topics. Topic One: the rulings of necessity related to the judicial divorce cases and the woman’s waiting periods.Topic Two: addressing the rulings of necessity related to penalties (punishments). The research’s purpose: To state the jurisprudential rulings related to women in a very crucial aspect which is the necessity aspect. The methodology adopted in the rooting aspect: To follow the methods of the Muslim scholars (fundamentalist scholars, jurists, and exegetes) when justifying a ruling as being a necessity, stating that, by doing so, they do not restrict the necessity to the aspect of utter destruction and damage. Rather, the necessity includes every dire need that cannot be restrained and leads to committing an unlawful act or leaving out a compulsory lawful one. As for the methodology adopted in the applied aspect, it is the jurisprudential, comparative study of the rulings in the four jurisprudential schools, with reference to the approved books in each school when identifying the points of agreement and disagreement among these schools. The research is concluded by demonstrating the tolerance of the Islamic Law and its consideration of all human conditions, in addition to stating the meaning of necessity and the difference between it and need. In conclusion, the research’s recommendation is for giving attention to the subject of necessity and investigating it in other aspects such as: the rulings of necessity related to the jurisprudence of Muslim minoritie.
