Abstract : الاختصاص النوعي للمحاكم التجارية في النظام السعودي Jurisdiction of Commercial Courts According to The Saudi Law بحث تكميلي لنيل درجة الماجستير في الأنظمة إعداد حنان يحي سعيد مشبب الرقم الجامعي: 1800033 إشراف الدكتور هشام موفق عوض العام الجامعي 1441هـ/2020م Abstract The Saudi legeslton was keen to establish a specialized judiciary to adjudicate commercial disputes, this response to the nature of these transactions and is in itself a positive indicator. A first step would encourage legitimate competition in commercial transactions and attract foreign investment. The terms of reference of the commercial courts provided for in the judicial and procedural systems are those of the courts It is highly consistent with the nature of the judicial function of the commercial courts, this gives the Saudi judicial law. Saudi Arabia is the first and the leading Arab judicial law in this regard. The Saudi regulator has defined the specific jurisdiction of the commercial courts In article 35 of the new law of legal proceedings Issued by Royal Decree No. (M/1) and dated 22/1/1435. The law of commercial courts was recently promulgated by Royal Decree No. M/93 and dated 15/8/1441 ,which provided for the jurisdiction of the commercial courts in article 16. The need to address this issue was highlighted by study and analysis In order to accurately identify and identify those terms of reference It avoids conflicts of jurisdiction in commercial courts and between other jurisdictions and tribunals in Saudi arabia. This development in the Kingdom achieves the speed of adjudication in the cases before it In accordance with the nature of the business transaction. This study focuses on the identification of the quality control of commercial courts.
